FOIL Requests for Orangetown Police Records

New York's Freedom of Information Law gives the public access to government records. In Orangetown, the online FOIL portal is the primary submission method. The Town Clerk's Office at (845) 359-5100 ext. 5004 handles general FOIL inquiries and can answer questions about procedures.

Records in Orangetown are defined broadly under FOIL to include tape recordings, microfilm, computer discs, and other media types, not just paper documents. Nine categories of records may be withheld: records exempted by state or federal statute; unwarranted invasions of personal privacy; records that would impair contract awards or collective bargaining; trade secrets or commercial enterprise records; law enforcement records that would interfere with investigations, fair trials, or reveal confidential sources; records that would endanger life or safety; inter-agency communications with exceptions; exam questions before administration; and computer access codes.

Privacy exemptions have three exceptions where records can still be released: if identifying details are deleted, if the person consents in writing, or if the person is seeking their own records. Denial must be in writing with reasons and appeal rights. Reports sent electronically are at no cost. In-person copies are $0.25 per page. Accommodations are made for financial hardship. For statewide FOIL guidance, visit opengovernment.ny.gov.

All Orangetown police data is also sent to the NYS Division of Criminal Justice Services and is publicly posted at criminaljustice.ny.gov. If you want aggregate crime statistics for Orangetown rather than individual reports, that state database is a good starting point and does not require a FOIL request.
